Hypnosis Without Trance (HWT) Web Site Agreement and Purchasing Terms and Conditions
Important! These terms of service (ToS) and terms and conditions govern your use of this site. Please read this document carefully before accessing or using the site. By accessing or using the site, you agree to be bound by the terms and conditions set forth below. If you do not wish to be bound by these terms and conditions, you may not access or use the site.
Hypnosis Without Trance may modify this agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement on the site. You agree to review the agreement periodically to be aware of such modifications and your continued access or use of the site shall be deemed your conclusive acceptance of the modified agreement.
1. Use of the Site
Limitation of Liability
In no event will Hypnosis Without Trance be liable for…
(i) any incidental, consequential, or indirect damages (including, but not limited to, damages for loss of profits, business interruption, loss of programs or information, and the like) arising out of the use of or inability to use the service, or any information, or transactions provided on the service, or downloaded from the service, or any delay of such information or service. Even if Hypnosis Without Trance or its authorised representatives have been advised of the possibility of such damages, or…
(ii) any claim attributable to errors, omissions, or other inaccuracies in the service and/or materials or information downloaded through the service. Because some states do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply to you. In such states, Hypnosis Without Trance liability is limited to the greatest extent permitted by law.
Hypnosis Without Trance makes no representations whatsoever about any other web site which you may access through this one or which may link to this Site. When you access a non-Hypnosis Without Trance web site, please understand that it is independent from Hypnosis Without Trance, and that Hypnosis Without Trance has no control over the content on that web site. In addition, a link to a Hypnosis Without Trance web site does not mean that Hypnosis Without Trance endorses or accepts any responsibility for the content, or the use, of such web site.
You accept that you are 100% responsible for your own actions and your use of any material taught via Hypnosis Without Trance, and we accept no liability, implied, or otherwise, should the use of our products or services cause personal injury, loss of earnings or any other negative impacts.
We will be more than happy to offer support and assistance where possible to resolve any issues you may have as a result of applying the teachings of Hypnosis Without Trance.
2. Copyright, Licenses and Idea Submissions
Except where otherwise stated the entire contents of the Site and all Hypnosis Without Trance products are protected by international copyright and trademark laws. The owner of the copyrights and trademarks is James Rolph (AKA James Tripp).
YOU MAY NOT MODIFY, COPY, REPRODUCE, REPUBLISH, UPLOAD, POST, TRANSMIT, OR DISTRIBUTE, IN ANY MANNER, THE MATERIAL ON THE SITE OR WITHIN THE PRODUCTS, INCLUDING TEXT AND/OR GRAPHICS. You may print and download portions of material from the different areas of the Site solely for your own non-commercial use provided that you agree not to change or delete any copyright or proprietary notices from the materials.
Idea Submissions: You agree to grant to Hypnosis Without Trance a non-exclusive, royalty-free, worldwide perpetual license, with the right to sub-license, to reproduce, distribute, transmit, create derivative works of, publicly display and publicly perform any materials and other information (including, without limitation, ideas contained therein for new or improved products and services) you submit to any public areas of the Site (such as bulletin boards, forums, comments sections and newsgroups) or by e-mail to Hypnosis Without Trance by all means and in any media now known or hereafter developed
You also grant to Hypnosis Without Trance the right to use your name in connection with the submitted materials and other information as well as in connection with all advertising, marketing and promotional material related thereto. You agree that you shall have no recourse against Hypnosis Without Trance for any alleged or actual infringement or misappropriation of any proprietary right in your communications to Hypnosis Without Trance.
3. Indemnification
You agree to indemnify, defend and hold harmless Hypnosis Without Trance and any third party information providers to the Service from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement (including negligent or wrongful conduct) by you or any other person accessing the Service.
4. Terms and Conditions relating to Product Purchases
(i) Refunds and Replacements: Due to the nature of the products we sell, refunds will not be issued to consumers based on satisfaction relating to content, features or production values.
Sufficient information is provided to make informed choices about your purchases with us. All informational content delivered in Hypnosis Without Trance products is 100% legitimate and of the highest quality. All testimonials and reviews are genuine, all content descriptions are accurate, and many representations of James Tripp’s teaching style are available to view via the Hypnosis Without Trance Blog.
Should any items be found to be damaged or malfunctioning, they will be happily replaced at cost to Hypnosis Without Trance.
(ii) Formats: All DVD’s shipped by Hypnosis Without Trance are PAL format. This means that if you are in an NTSC or SECAM country, you WILL be able to watch the DVD’s on PC or MAC, but MAY experience difficulties viewing on standard televisions!
All downloads will be AVI or MP4 for Video, MP3 for Audio and PDF for documents. All programme purchases are supported by live monthly Q & A webinars via complimentary membership to the HWT Developing Group.
(iii) Delivery: When purchasing physical products, please leave up to 6 weeks for delivery. Whilst we ship with 72 hours, orders can sometimes be delayed in customs or by overseas postal services.
Should a product have failed to arrive after 6 weeks, we will either re-ship, or refund (depending upon your preference).
All physical products are tracked during shipping and require a signature on delivery.
Digital downloads will be made available to customers via the HWT members area and are for the sole use of the purchasing customer. All programme purchases are supported by live monthly Q & A webinars via complimentary membership to the HWT Developing Group.
(iv) Customer Care: Should you require any post purchase assistance, please do not hesitate to contact us and we will do our best to help.
5. Terms and Conditions Relating to Live Events (including coaching and mentoring)
(i) Filming: Workshops, trainings and events may be filmed, sound recorded and/or photographed – you are accepting this upon booking and by attending you are consenting to being photographed and filmed!
(ii) Cancellations, Refunds and Transfers: A 50% refund of the agreed price is payable as refund for all cancellation requests received in writing 28 days prior to commencement of the course. We offer no refund for cancellations made after 28 days prior to commencement of the course.
Alternatively you may wish to transfer your booking to a later equivalent course. A £75 additional transfer fee is payable on all transfers.
(iii) Cancellation by Hypnosis Without Trance: In the unlikely event of cancellation by HWT you will receive a refund in full for all monies paid. Alternatively you may choose a 10% refund and transfer to the next scheduled equivalent course.
(iv) Delivery: HWT reserve the right to make changes as required to course formats (excluding course duration). We also reserve the right to make minor venue changes if necessary. Aside from these points all courses will be delivered as stipulated in the course description. HWT, or representatives therof, are not responsible for additional costs such as travel and accommodation.
(v) Additional Notes: Prior to the commencement of the course you may be required to sign a statement that you are physically and mentally fit to partake in the training, as well as consent forms pertaining to audio and video recording (workshops are often recorded for the purpose of evaluation. Occasionally we use recordings in marketing and educational materials).
Delegates are also expected to treat each other and all trainers, assistants and guests with respect and to receive evaluation and feedback with good grace and an open mind. In order to ensure an enjoyable and effective learning experience for all, we reserve the right (as a last resort) to expel without refund any delegate who behaves disruptively or is disrespectful to others.
6. Privacy Policy
All details obtained during registration, ordering or other activity on our site are held with the strictest confidence. We will never sell or give your information to any external companies or sites.

7. Affiliate Sales
Anyone found to be committing fraud will have their affiliate accounts suspended and all funds frozen.
Affiliate commission will be reversed for refunded sales and will be reported as a negative sale in the sales report.
8. Terms of Service / Terms & Condition Changes
Changes to our Terms of service and terms & conditions will be made without direct notification. It is your responsibility to ensure you check for changes in our terms of service and terms & conditions.
